EU-U.S. and Swiss-U.S. Privacy Shield Frameworks
Signiant is aware of the July 16, 2020 decision of the European Court of Justice relating to the EU-US Privacy Shield and the September 8, 2020 opinion of the Federal Data Protection and Information Commissioner of Switzerland (“FDPIC”) relating to the Swiss-US Privacy Shield, in each case causing the applicable Privacy Shield Framework to be unavailable as a valid mechanism for data transfers to the United States. Nevertheless, in accordance with guidance from the United States Department of Commerce, Signiant continues to be responsible for its obligations under both frameworks. Accordingly, We remain committed to the Privacy Shield Frameworks as set forth below, pending the outcome of negotiations between the Commerce Department and EU and Swiss authorities for an enhanced Privacy Shield program or successor program. In the meantime, for concerned clients, Signiant will be happy to enter into an appropriate data processing addendum, including the standard clauses approved by the European Commission and recognized by the FDPIC and the United Kingdom (“UK”) Information Commissioner.
Signiant participates in and has certified its compliance with the EU-U.S. and Swiss-U.S. Privacy Shield Frameworks (collectively, the “Privacy Shield”). We are committed to handling all Personal Data received from European Union (“EU”) member countries, the UK, and Switzerland, respectively, in reliance on the Privacy Shield and in accordance with the Privacy Shield’s applicable Principles. To learn more about the Privacy Shield, visit the U.S. Department of Commerce’s Privacy Shield List at http://www.privacyshield.gov/list.
Under the Privacy Shield, we are responsible for the processing of Personal Data we receive and subsequently transfer to a third party acting as an agent on our behalf. We comply with the Privacy Shield Principles for all onward transfers of Personal Data, including the onward transfer liability provisions.
With respect to Personal Data received or transferred pursuant to the Privacy Shield, we are subject to the regulatory and enforcement powers of the U.S. Federal Trade Commission. In certain situations, we may be required to disclose Personal Data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
If you live in the EU or Switzerland and have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact our U.S.-based third party dispute resolution provider (free of charge) at https://feedback-form.truste.com/watchdog/request. Under certain conditions, more fully described on the Privacy Shield website, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.
Our Service is directed at a general audience, and we do not intend to market to or collect, nor do we knowingly collect, Personal Information from children under the age of 13. Unfortunately, we cannot always determine the age of a visitor to our website or the sender of an email. If you have reason to believe that a child under the age of 13 has provided Personal Information to us, please contact us, and we will endeavor to delete that information from our databases.
You agree that any dispute over privacy or the terms contained in this Policy will be governed by the laws of the United States and the Commonwealth of Massachusetts. Any legal action or proceeding relating to this Policy or your access to or use of this Site shall be instituted in a state or federal court in the Commonwealth of Massachusetts. You agree to submit to the jurisdiction of, and agree that venue is proper in, such courts. You may have additional rights under applicable data protection laws in your jurisdiction, and nothing in this Policy is intended to limit your rights in violation of such laws.
We reserve the right to amend the Policy at any time to reflect changes to our information practices or for any other reason, without notice to you, other than the posting of the amended Policy on our website. However, if we make any material changes we will notify you by email (sent to the email address specified in your account) or by means of a notice on our website prior to the change becoming effective.
